These Terms and Conditions ("Terms") govern your use of the Bob Worner LLC website and your participation in our auctions. By creating an account or placing a bid you agree to these Terms.

1. The platform

Bob Worner LLC ("Bob Worner", "we", "us") operates online sealed-bid (blind) auctions of used equipment and vehicles — heavy and agricultural machinery, and classic cars — in the United States.

2. Eligibility and accounts

  • You must be at least 18 years old and able to enter binding contracts.
  • You must register with accurate information, confirm your email address, and be approved by our team before bidding.
  • You are responsible for all activity under your account and for keeping your password secure. We may suspend or close accounts that violate these Terms.

3. Blind auction rules

  • All auctions are sealed-bid: bids are confidential and never shown to other bidders.
  • Every bid is a binding offer to purchase at the amount entered. Bids cannot be edited or withdrawn after submission unless we expressly allow it in writing.
  • Auctions close at the date and time shown on the listing, enforced server-side. Bids received after closing are not accepted.
  • The winning bid is selected by Bob Worner LLC after the auction closes — normally the highest qualified bid. We reserve the right to reject any bid, to decline to sell, or to relist an item.
  • All bids are timestamped and logged, including the IP address and device used, for fraud protection and audit purposes.

4. Condition of equipment — AS-IS, WHERE-IS

All equipment and vehicles are used and sold "AS-IS, WHERE-IS", with all faults and without any warranty, express or implied, including warranties of merchantability or fitness for a particular purpose. Listing descriptions, photos, videos, hour readings, and specifications are provided in good faith from information available to us but are not guaranteed. You are responsible for satisfying yourself about a machine's condition before bidding; pre-bid questions are welcome via our support team. This does not displace the delivery windows in our Delivery Inspection & Condition Review policy: transport damage may be reported within 48 hours of delivery, and a machine that is materially different from the lot as listed may be raised for review within 7 days of delivery. Any resulting remedy is determined case by case.

5. Winning, payment, and default

  • Winning bidders are notified by email and receive an invoice.
  • Payment in full is due by bank wire transfer within 48 hours of the winner notification unless the invoice states otherwise. Applicable sales taxes are added unless you provide a valid exemption certificate.
  • If payment is not received on time, we may cancel the sale, select another bid, relist the machine, and/or suspend your account. You are liable for costs caused by your default.

6. Delivery and title

We arrange nationwide delivery for winning bids at a distance-based freight rate that we partially subsidize, as described in our Shipping & Delivery Policy. Delivery cost is additional to the winning bid and is shown on your invoice. Title and ownership documents transfer after payment clears. Risk of loss passes to you on delivery.

7. Prohibited conduct

You may not: bid without intent to pay; use multiple accounts; interfere with the operation of the site; scrape or republish listing content; or use the platform for any unlawful purpose.

8. Limitation of liability

To the maximum extent permitted by law, Bob Worner LLC's total liability arising out of any auction or use of the site is limited to the amount you paid to us in the transaction giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or downtime.

9. Disputes and governing law

These Terms are governed by the laws of the state in which Bob Worner LLC is registered, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute informally through our support team.

10. Changes

We may update these Terms from time to time. The version published on this page at the time you place a bid applies to that bid.
